1. Acceptance of Terms

By accessing or using MyStockCaribbean ("the Platform," "we," "us," or "our"), you agree to be bound by these Terms and Conditions. MyStockCaribbean is a digital marketplace dedicated to authentic Caribbean stock media, including photographs, videos, illustrations, and other creative assets. If you do not agree to these terms, please do not use the Platform.

2. Eligibility

You must be at least 18 years of age to create an account, purchase licenses, or contribute content to MyStockCaribbean. By using the Platform, you represent and warrant that you meet this age requirement and have the legal capacity to enter into a binding agreement.

3. Account Registration

To access certain features, you must register for an account. You agree to:

• Provide accurate, current, and complete information during registration.
• Maintain and promptly update your account information.
• Keep your password confidential and not share it with third parties.
• Notify us immediately of any unauthorized use of your account.
• Accept responsibility for all activities that occur under your account.

4. Purchases and Licensing

All media purchased on MyStockCaribbean is licensed, not sold. Licenses grant you specific rights to use the media as outlined in our Licensing Terms. Purchases are final. Refunds may be issued at our sole discretion in cases of technical error or duplicate purchase. By completing a purchase, you agree to our Licensing Terms and acknowledge that unauthorized use of licensed media may result in account termination and legal action.

5. Contributor Obligations

Contributors who upload content to MyStockCaribbean agree to:

• Own or have the necessary rights to all submitted content.
• Obtain valid model and property releases where required.
• Ensure content does not infringe any third-party intellectual property rights.
• Comply with all applicable laws, including those of the Caribbean jurisdictions in which content is captured.
• Accurately describe and categorize submitted content.

6. Prohibited Conduct

You agree not to:

• Upload content that is defamatory, obscene, or violates any law.
• Reverse engineer, scrape, or systematically download Platform content.
• Use the Platform to distribute malware or engage in fraudulent activity.
• Misrepresent your identity or affiliation with any person or organization.
• Circumvent any access controls or security measures on the Platform.

7. Intellectual Property

All Platform design elements, logos, trademarks, and software are the exclusive property of MyStockCaribbean or its licensors. Media content remains the intellectual property of the contributing creators. Nothing in these Terms transfers ownership of any intellectual property to you.

8. Limitation of Liability

To the fullest extent permitted by applicable law, MyStockCaribbean shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform, including but not limited to loss of profits, data, or goodwill. Our total liability for any claim shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

9. Governing Law

These Terms and Conditions are governed by the laws of Trinidad and Tobago, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Trinidad and Tobago.

10. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify registered users of material changes via email or a prominent notice on the Platform. Continued use of the Platform after changes take effect constitutes your acceptance of the revised Terms.
